1. Introductory provisions
a. The provision of accommodation, catering and other services to clients and the accommodation of clients in Golden Apartments is governed by the generally binding legal regulations in force in the territory of the Slovak Republic and these General Terms and Conditions (hereinafter referred to as "GTC"), which are also the accommodation regulations. The client accepts the General Terms and Conditions as a contractual condition for accommodation in Golden Apartments and the use of services provided by the Operator and is obliged to comply with their provisions.
b. The General Terms and Conditions are published at the reception of Golden Apartments and on the company's website. c. The operator reserves the right to unilaterally change the provisions of the General Terms and Conditions, while the change of General Terms and Conditions is effective from the date of their publication on the website and at the reception of the resort.
2. General business conditions
a. These General Terms and Conditions apply to contracts for the accommodation of persons in Golden Apartments, contracts for the rental of accommodation facilities and other facilities in Golden Apartments for events and for the performance of events for rent, as well as for all other services provided to the client by the Operator. Other commercial and contractual terms and conditions shall apply to the relationship between the Operator and the client only if they are agreed in advance in writing between the contracting parties.
b. The accommodation contract between the Operator and the client is established by written confirmation of the client's verbal or written request to reserve accommodation in Golden Apartments. The accommodation contract is concluded for a fixed period.
c. The parties to the contract are the Operator and the client. When ordering accommodation or other services by a third party, this person is liable to the Operator together with the client as a joint debtor for all obligations arising from the contract.
d. Any sublease or sublease of Golden Apartments rooms or facilities, as well as their use for purposes other than accommodation, or for purposes other than contractually agreed upon, require the prior written consent of the Operator.
3. Conditions for providing accommodation services to clients
a. The operator can only accommodate a client who is properly registered for accommodation in Golden Apartments. The client checks in at the Golden Apartments reception immediately upon arrival. To register, the client is obliged to present his identity card to the responsible reception staff - ID card, passport or other valid identity document in accordance with Act No. 253/1998 Coll. o on reporting the residence of SR citizens in the register of SR residents as amended and in accordance with Act no. 18/2018 Coll. on the protection of personal data as amended.
b. Every client who is not a citizen of the Slovak Republic is obliged pursuant to Act No. 404/2011 Coll. about the stay of foreigners, fill out and hand over to the responsible reception worker the official form about reporting the stay for the foreign police, presented to the client upon arrival.
c. The client is obliged to provide all required data truthfully, completely and accurately.
d. The reservation can be made in one's own name or for the benefit of a third person, registration and issuing of keys, access cards, room chips is possible only in the presence of the person in whose name the reservation is registered.
e. In exceptional cases, the operator can offer the client other accommodation than what was agreed, as long as it does not differ significantly from the accommodation agreed in the confirmed order.
f. Unless otherwise agreed with the client, reserved accommodation in Golden Apartments is available to the client from 14:00 on the agreed day of the client's arrival. The client has no legal right to earlier use of reserved accommodation in the resort.
g. In the event of deficiencies in the provided accommodation, or additional service, the consumer shall exercise the right to claim without undue delay. After the warranty period expires, the right to claim expires.(When making a complaint, the consumer submits proof of payment for the services whose errors he complains about)
h. The accommodation used by the client must be vacated on the agreed day of the client's departure and handed over by the client to the operator no later than 10:00 a.m.
i. The accommodation is considered vacated and handed over by the client to the Operator after the client takes out all his belongings, hands over the keys, access cards, access chips from the accommodation, the card used to pass to the Golden Apartments private parking lot to the responsible employee of the Golden Apartments reception and informs him of the check-out from the accommodation . The operator reserves the right to check the inventory of the room, the payment and any consumption by the client, no later than one hour after the room is vacated and handed over to the client. The damage and inventory price list is available at the reception. In case of loss of the entrance card/keys to the accommodation, a loss fee of €25.00/piece without VAT will be charged!
j. The Operator may rent the reserved type of accommodation, in which the client has not moved in by 22:00 on the agreed day of the client's arrival at the latest, to a third party. This does not apply if a later arrival of the client has been expressly agreed between the Operator and the client. In case of prearranged arrival after 10:00 p.m., the Operator has the right to charge the client a fee for late arrival in the amount of €20.
k. If the client asks the Operator to extend the agreed period of accommodation, the Operator can also offer him a different type of accommodation at a different price than the one in which the client was originally accommodated. The client is not entitled to accommodation in the type of accommodation in which he was originally accommodated or to another type of accommodation in Golden Apartments, if it is not possible to provide accommodation to the client due to capacity or operational reasons of Golden Apartments.
l. The client is entitled to use Golden Apartments services only if he agrees to the General Terms and Conditions. The client is advised in his own interest to familiarize himself with these GTC before making a reservation. When repeatedly using the services of Golden Apartments, the client is always obliged to familiarize himself with the current version of the General Terms and Conditions. By confirming the reservation, the client confirms that he has familiarized himself with the Terms and Conditions and their annexes, agrees with them and undertakes to comply with them.
4. Payment for services rendered
a. The price list of services provided by the Operator is available for inspection at the Golden Apartments reception and on the Operator's website.
b. The price of a recreational stay in Golden Apartments includes: only the price for accommodation.
c. The price of a recreational stay at Golden Apartments does not include: accommodation tax - payable at the reception upon check-in €3 / night / adult and child over 12 years old.
d. In case of binding registration, the Operator is entitled to demand from the client an advance payment in the amount of 100% of the total amount with payment within 24 hours of confirmation of the reservation. However, the payment must be credited to the Operator's account no later than 48 hours before the start of the stay.
e. The operator accepts both cash and non-cash payments (by bank transfer or payments via a terminal).

g. The client is obliged to pay the agreed contractual prices according to the price list for accommodation and other services used by him.
h. If the client shortens his agreed stay at the resort, the Operator has the right to charge the client the full amount of the agreed price for the entire length of the agreed stay at the resort.
i. In the event that the Operator cancels the stay after the deposit has been paid, the Operator will return the already paid deposit in accordance with the cancellation conditions, see Article 6 of these GTC.
j. A refundable deposit of €50 per accommodation unit is paid in advance for accommodation. After checking the accommodation facility, in the event that there has been no damage to things and in the event that the accommodation is left in the condition specified in point t. part no. 5 of the General Terms and Conditions, the deposit will be returned to the client at the end of the stay.
k. In the event that the Operator does not receive the payment for the stay by the due date, or a written statement about changing the due date cancels the stay reservation.
5. Responsibility of the client and the Operator
a. The operator is not responsible for damage to things brought in and left by the client in the premises of Golden Apartments. The Operator is not responsible for jewels, money and other valuables.
b. The operator is not responsible for forgotten and lost belongings of the client in the premises and Golden Apartments. Found things are sent to the client by mail based on the written request of the client, who pays all costs associated with it. Found items are stored at the reception for one month.
c. The operator is not responsible for possible injuries during the stay. In the event of illness or injury of the client, the Operator will ensure the provision of necessary medical assistance or transport to the hospital.
d. It is the client's duty to always behave in such a way that his actions do not endanger his health or the health of other guests.
e. The client is responsible for the damages caused by him in full and is obliged to pay the entire amount of the damaged item without delay.
f. In case of gross violation of the accommodation conditions, including profanity, violence, inappropriate behavior, the client may be asked to leave the Golden Apartments immediately without the right to return the already paid stay.
g. In the accommodation facility, in the premises of Golden Apartments, the client may not move the Operator's equipment or make any modifications or interventions to the Operator's equipment without the Operator's consent.
h. In the accommodation facility, in other premises of the Golden Apartments Operator, the client may not use his own electrical appliances without the Operator's consent.
i. For safety reasons, the client is not entitled to leave children under the age of 10 without the supervision of an adult in the accommodation facility or in other areas of Golden Apartments. The parent/responsible person is responsible for the safety and damage caused by children in the accommodation facility or in other areas and grounds of the Resort.
j. The client is not authorized to bring weapons and ammunition into the complex or accommodation premises of Golden Apartments.
k. Between 10:00 p.m. and 7:00 a.m., the client must strictly observe night time in the Golden Apartments accommodation facility.
l. Accommodation of animals (dog, cat, hare and other animals in a cage) is not allowed even for an additional fee in all accommodation units of Golden Apartments.
m. It is strictly forbidden to smoke cigarettes, cigars, IQOS or their similarities in the accommodation and social facilities of Golden Apartments. It is forbidden to use any narcotic and psychotropic substances. The operator is entitled to charge the amount of EUR 150 for violating this prohibition. Smoking is allowed only in designated areas, namely in the Golden Apartments hotel bar.
n. If the Client is provided by the Operator with a parking space to park the client's motor vehicle in a private parking lot, the Operator is not responsible for the loss or any damage to the client's motor vehicle and the things in this motor vehicle. Parking in the private parking lot is only possible in reserved places!
o. Visits of accommodated guests are registered in the book Visits at the reception. Visits must be reported immediately upon arrival at the reception desk. Visitors are required to leave Golden Apartments by 10:00 p.m. In the event of non-compliance with this regulation, visitors or those staying will be charged the amount per night according to the relevant price list. The operator reserves the right in case of violation of this point to contact SBS or PZ of the Slovak Republic in order to find out the identity of the unannounced and unregistered visit without the knowledge of the guest, based on the 24/7 monitoring record.
p. According to Act no. 219/1996 Coll. prohibition to sell and serve alcoholic beverages to persons under the age of 18 and persons clearly under the influence of alcohol.
r. It is forbidden to start a fire, grill or manipulate fire in any way throughout the Golden Apartments of the resort.
s. Complaints from clients and possible proposals for improving the Operator's activities are accepted in writing by the responsible reception staff. with. Upon arrival at the accommodation, the client is obliged to check the condition of the accommodation unit and the inventory according to the inventory list placed in the accommodation unit. Any damage or discrepancies must be reported to the reception immediately.
t. When leaving the room, the client is obliged to close the water taps, turn off the electric lighting and other appliances in the room and adjacent areas (radio, television, etc.) and close the door.
u. The accommodation must be handed over in the condition in which it was received = without damage to structures and equipment, inventory and room equipment in the same place and in the same number as on arrival, kitchenware washed, dried and stored in the appropriate place. In the event of non-compliance with these conditions, the operator reserves the right to an additional fee for services beyond the agreed upon. Additional service – washing and putting away kitchen utensils, or moving furniture to its original place is charged with a one-time fee of €20. In case of any damage to the inventory/accommodation, the client is obliged to report this situation at the reception before checking out of the accommodation.
v. The client is not allowed to take into the room sports equipment and objects for which a place is reserved for safekeeping.
x. If a guest causes property damage to Golden Apartments, the operator is entitled to financial compensation on the spot. The amount will be specified based on the price list freely available at the reception or based on the purchase price. In the event that Golden Apartments, through an authorized person of the operator, and the guest do not agree immediately and voluntarily on the spot, the operator has the right to call the police patrol to settle the damage.
y. In case of violation of the obligations and prohibitions specified in this article of the general terms and conditions/accommodation rules, the Operator is entitled to demand from the client the payment of a contractual fine in the amount of €100 for each individual violation of obligations.
6. Withdrawal, change or cancellation of the order and cancellation
a. The Client has the right to withdraw from the contract at any time before the start of the accommodation by notifying the Operator in writing. Any change in the confirmed order (number of persons, change in the scope of reserved services, restriction or extension, etc.) must be reported no later than 48 hours before the start of the stay. Such changes are only possible if the operational or capacity possibilities of Golden Apartments allow it.
b. If the client secures compensation for himself, he is exempt from the cancellation fee.
c. The operator is entitled to withdraw from the contract if:
c1. an event of force majeure occurs or other circumstances arise for which the Operator is not responsible, as a result of which the fulfillment of contractual obligations becomes impossible;
c2. When booking accommodation, the client provided misleading or false information regarding essential facts for the conclusion of the contract;
c3. The Operator reasonably believes that the use of its services could endanger the operation of the facility, the safety of third parties or the reputation and good name of the Operator of Golden Apartments.
c4. In case of withdrawal from the contract by the Operator, the client is not entitled to severance pay, compensation or damages.
7. Alternative dispute resolution
Consumers have the right to out-of-court dispute resolution through ADR and the ODR platform.
In the event that the customer, a consumer who, when entering into and fulfilling a consumer contract, does not act within the scope of his business, employment, or profession, is dissatisfied with how the operator, as the seller, handled his complaint or believes that the operator has violated his rights, the customer has the right to contact the operator as the seller with a request for remedy. If the operator responds negatively to the customer's request or does not respond to such a request within 30 days from its dispatch by the customer, the customer has the right to submit a proposal to initiate alternative dispute resolution to the entity of alternative dispute resolution under § 12 of Act No. 391/2015 Coll. on alternative consumer dispute resolution and on the amendment and supplementation of certain laws.
The relevant entity for alternative consumer dispute resolution with the operator as the seller is:
a) the Slovak Trade Inspection, which can be contacted for this purpose at the address Central Inspectorate of SOI, Prievozská 32, P.O. Box 29, 827 99 Bratislava, or electronically at adr@soi.sk or
b) another authorized legal entity registered in the list of alternative dispute resolution entities kept by the Ministry of Economy of the Slovak Republic (the list of authorized entities is available at http://www.mhsr.sk/zoznam-subjektov-alternativneho-riesenia-spotrebitelskych-sporov/146987s), with the customer having the right to choose which of the mentioned entities of alternative dispute resolution to contact. The customer can use the online platform for alternative dispute resolution to submit a proposal for the alternative resolution of his consumer dispute, which is available at http://ec.europa.eu/consumers/odr/index en.htm. More information about alternative consumer dispute resolution can be found on the website of the Slovak Trade Inspection: http://www.soi.sk/sk/Alternativne-riesenie-spotrebitelskych-sporov.soi.
Slovak law applies.
8. Protection of personal data
a. The client in accordance with the provisions of Act no. 18/2018 Coll. on the protection of personal data as amended, declares that he was familiar with the rights and obligations regarding the acquisition and processing of personal data by the Operator according to this law.
b. The Client grants the Operator consent to the acquisition, processing and storage of the client's personal data indicated on the request for booking accommodation at the Resort or in the order, for the purpose of securing and providing the Client with the services ordered by the Operator and for the fulfillment of the Operator's obligations imposed by law for the necessary period.
c. The Client grants the Operator consent to the acquisition and processing of personal data also for the needs of the Operator's marketing activities, in particular for participation in the Operator's loyalty and similar programs for the period during which these activities are carried out.
d. By providing personal data, the client consents to their storage in the company's database and information system. To ensure the protection of personal data, the Operator has prepared security documentation. Only persons trained in accordance with the law work with personal data.
e. All personal data obtained during a visit to the website of the Department are processed in accordance with the law.
f. The operator declares that it does not sell, trade or in any other way provide the client's personal data to third parties,
g. To increase the security of the guests, Golden Apartments is monitored by a camera security system 24/7 in accordance with the above-mentioned Act on the Protection of Personal Data.
h. The withdrawal of the client's consent can be done in writing with or without giving a reason.
8. Final Provisions
a. If any provision of these GTC is or becomes invalid or unenforceable, this will not affect the legality, validity or enforceability of the remaining provisions of these GTC, except if the importance or other circumstances relating to the invalid provision of these GTC means that the provision in question cannot be severed from of the remaining provisions of these GTC.
b. These General Terms and Conditions and the legal relationships established on their basis are governed by the legal order of the Slovak Republic.
c. These General Terms and Conditions become valid and effective on January 1, 2023. By delivering the reservation, confirming it and subsequently paying the deposit for the services, the client confirms that he is familiar with the general terms and conditions and that he agrees with their content.
